E-lixr Water Taxi
Article 1 – Definitions
In these terms and conditions, the following words have the following meaning:
Private Ride: Service provided by E-lixr that provides a group of up to 6 people with a private ride, booked by a single individual on a request basis.
Social Ride: Service provided by E-lixr that provides individual ticketed rides to passengers on a fixed schedule.
Primary Passenger: Person who reserved and purchased access to a Water Taxi provided by E-lixr, Inc (“E-lixr”)
Guests: Any guests or party members of the Primary Passenger.
Vessel: The boat being used by E-lixr to execute the Water Taxi services.
Article 2 – Ride Details
Ride Date: The date that the ride is agreed upon.
Ride Duration: The amount of time the ride takes to get from point a to point b. Should not exceed 30 minutes unless otherwise noted.
Ride Fee: The flat fee of $150 per trip for Private Rides, or $25 for Social Rides, regardless of pick up or drop off location.
Late Fee: There is a 10 minute waiting period on Private Rides for the Primary Passenger and their Guests to arrive. After 10 minutes, the Primary Passenger will be charged a $20 late fee. Social rides run on a set schedule and will not wait for late passengers.
Embarking Rules: Please note that outside glassware and alcohol are not permitted on the Vessel.
Landing Fees: Any additional landing fees associated with the Primary Passenger’s itinerary on Private Rides.
Captain: The owner provides the captain for this service.
Maximum Number of Persons: The Vessel shall not, at any time during the Ride Duration, exceed the maximum number of six (6) persons (excluding Captain and Crew) onboard the Vessel. If children are taken onboard, the Primary Passenger will be fully responsible for their safety and conduct.
Article 3 – Cancellation

All cancellation requests must be made by the Primary Passenger in writing to the Owner’s valid email address, ride@elixr.miami. Changes or cancellations to the Ride will be subject to the following terms:

Cancellation within 30 minutes of Ride start time or no show will result in a full charge.

Cancellation within 6-12 hours of Ride start time will result in an account credit for future use.

Cancellation with 12 hours or more of Ride start time will result in a full refund.

Article 4 – Primary Passenger and Guest Liability and Obligation
Primary Passenger’s Liability: The Primary Passenger shall be liable for costs or losses as incurred (or likely to be incurred) from damage caused by the Primary Passenger or their guests (intentionally or otherwise) to the Vessel or any third party. The Primary Passenger shall be responsible to the Owner of any loss, damage or injury caused by the willful or negligent acts of themself or their guests.
Assumption of Risk and Complete Release of Liability: The Primary Passengers knows and fully understands that riding any type of vessel is an outdoor adventure activity in an aquatic environment with inherent risks and hazards where serious accidents, injuries, or death can occur. The Primary Passenger fully understands that the Vessel has limited medical facilities and that in the event of illness or injury, appropriate care may be summoned and treatment will be delayed until the parties in need of care can be transported to a proper medical facility. The Primary Passenger, on behalf of themselves and their respective heirs, family, assignees, agents, estate, and affiliates, explicitly acknowledge and agree in advance to these conditions, accept and willingly assume all risks and hazards related to, arising out of, or associated with their participation in a charter on the Vessel, including all activities on and off the Vessel, and voluntarily agree to release, discharge, and hold harmless Owner and Captain, from any and all claims of liability. Primary Passenger, on behalf of themselves and their heirs, family, assignees, estate, agents, and affiliates, furthermore agree to fully indemnify Owner and Captain for any claims made by Primary Passenger’s guests, heirs, family, estate, assignees, or representatives.

No drugs, narcotics or weapons shall be used or brought on board the Vessel;

The Primary Passenger undertakes to comply with all seagoing rules and regulations currently in force and to obey the reasonable requests of the Captain;

The Primary Passenger and all members of their party shall take all reasonable care of the Vessel and its equipment; and
-
If the Primary Passenger or any of their Guests shall commit any offense contrary to the laws and regulations of any jurisdiction which results in the Vessel being detained, arrested, seized or fined the Primary Passenger shall indemnify the Owner against all loss, damage and expense incurred by the Owner as a result.
Article 5 – Landing Fees (applies to Private Rides only)
Additional Landing Fees according to the Primary Passenger’s itinerary will be charged separately from the Ride Fee with the card provided on file. This list may be incomplete as new landing sites are continuously added. Please refer to the booking page for a complete list.
